Administrative Review Committee


The Administrative Review Committee is established to review "reviewable decisions" as outlined in Part 18.1 of the Local Government Act 2019 (NT). A reviewable decision refers to a decision or order made by the Council or its officers, designated by the Act as eligible for review.

According to the Act, the following decisions are considered reviewable:

  • A decision regarding the correction of an entry in the assessment record (sections 232(1) or 233(7)).
  • A regulatory order under section 286.
  • A decision to refuse to suppress a person's details in publicly available material (section 293(5)).

Process for Reviewing a Reviewable Decision under the Local Government Act 2019 (NT)

  1. Identifying a Reviewable Decision

A reviewable decision is:

  • Designated as reviewable by the Local Government Act 2019 or a by-law.
  • Determined as reviewable by a resolution of the council.

The council must maintain a publicly accessible list of all categories of reviewable decisions on its website.

Examples of reviewable decisions under the Act:

  • Decisions related to correcting an entry in the assessment record (sections 232(1) or 233(7)).
  • Regulatory orders under section 286.
  • Decisions to refuse the suppression of personal details in publicly available material (section 293(5)).
  1. Applying for a Review

A person affected by a reviewable decision may apply for a review within 28 days of the decision. The application must:

  • Be submitted in writing to the CEO.
  • Clearly outline the grounds on which the decision should be reconsidered.

If there are exceptional circumstances, the CEO has the discretion to extend the 28-day deadline for submitting the application.

  1. Referral to the Administrative Review Committee

Upon receiving a review application, the CEO must refer the application to an Administrative Review Committee.

The committee has the authority to:

  • Summarily reject applications that are deemed frivolous, vexatious, or lacking substance.
    • If rejected, the committee must provide a written decision notice to the applicant as soon as possible.
  1. Committee Review and Recommendation

If the application is not rejected, the Administrative Review Committee will investigate the issues raised in the application. After its inquiry, the committee will make a recommendation to the council, which may include:

  • Confirming the original decision.
  • Amending the decision.
  • Revoking the decision.
  • Proposing further action to mitigate the decision's impact.
  1. Council's Final Decision

The council reviews the committee's recommendation and makes the final decision, which:

  • Does not have to align with the committee’s recommendation.
  • Must be communicated to the applicant via a decision notice as soon as possible, but no later than 90 days from the date the review application was received.
  1. No Council Decision

If the council fails to issue a decision notice within 90 days, the applicant has the right to refer the matter to the Northern Territory Civil and Administrative Tribunal (NTCAT) for further action.
